All employers, regardless of the Company size, are under a legal duty to prevent illegal working. Since coming into office in 2024, the Labour Government has been cracking down on illegal working. According to data from the CIPD:
- 748 civil penalty notices were issued to employers found to be hiring individuals without the right to work in the UK.
- These penalties amounted to a total of £41.6 million in fines, reflecting a significant financial impact on non-compliant businesses
All employers have a duty to carry out right to work checks prior to an employee being offered employment and these checks must be done for all employees, not just those who appear to be from overseas.
Failure to carry out proper Right to Work checks can result in fines of up to £60,000 per illegal worker, even if it was unintentional.
